Notarial Acts

ACKNOWLEDGMENT

Some document transactions require that the signer make a formal declaration in person, before a notary, therefore “acknowledging” the execution, or signing of the document.  The signer verbally acknowledges that:

  • They understand the contents and purpose of the document
  • The signature belongs to the signer who is in front of the notary
  • The document was signed willingly (no coercion)


Some of the documents that may require an acknowledgment could be a contract, deed, various written agreements, a power of attorney, etc.  These documents contain specific terms to which the signer is agreeing.


Documents requiring an acknowledgment can be signed prior to the time of notarization.   It must be clear that the signature is an original or "wet" signature.  


If the document is presented to the notary unsigned, the notary will scan for completeness, and have the signer sign the document.  The notary will also ask the signer for the acknowledgment:  

“Do you acknowledge or declare that you understand this document and you have signed it voluntarily for the purposes that are stated?”


The notary needs an affirmative  response from the signer, and will then complete the notarial act by filling out their  notarial certificate, signing and sealing the certificate.
